Terms of Use
1. Who we are
Forecourt is provided by Abbeygate Accountancy Ltd of Thurston, Bury St Edmunds, Suffolk ("we", "us"). You are the business that registers an account ("you", "the Dealer"). The person who registers confirms they have authority to accept these terms on the Dealer's behalf.
2. What Forecourt is
Forecourt is a tool to help you count and reconcile vehicle stock. It reads number plates from photographs, matches them against lists you upload, and produces reports. It is an aid to your own stock control process. It does not replace it, and the reports it produces are only as accurate as the lists and photographs you put in.
3. Your account and your people
You are responsible for everyone you invite, for keeping passwords private, and for removing people who leave. Everything done under your account is treated as done by you. Tell us straight away if you think an account has been compromised.
4. Your data
Stock lists, workshop diaries, statements, photographs and reports remain yours. We do not sell them, share them with other dealers, or use them for anything other than running the service for you and keeping it secure. You are the data controller for any personal data in that material (for example customer names on a workshop diary, or people caught in a photograph). We process it on your instructions as set out in the Privacy Notice, which forms part of these terms.
5. Acceptable use
Use Forecourt only for your own lawful stock control. Do not upload material you have no right to, attempt to access another business's data, probe or overload the service, or use automated plate reading on anyone else's premises. We may suspend an account that breaches this.
6. Availability and changes
We aim to keep Forecourt available but do not guarantee it will be uninterrupted or error free. We may change or withdraw features, and may withdraw the service on 30 days' notice, in which case you can export your reports before it closes.
7. Fees
Where fees apply they will be agreed with you in writing before they are charged. Until then the service is provided free of charge on a trial basis and may be withdrawn at any time.
8. What we are not responsible for
Forecourt is provided "as is". To the fullest extent the law allows, we exclude all warranties, and we are not liable for any loss of profit, business, stock, data or goodwill, or for any indirect or consequential loss, arising from your use of the service, a discrepancy the service did or did not report, or a decision you took on the strength of a report. Our total liability to you for anything arising out of the service in any 12 month period is limited to the fees you paid us for the service in that period, or £100 if you paid none. Nothing in these terms limits liability for death, personal injury, fraud, or anything else that cannot be limited by law.
9. Your indemnity to us
You will indemnify Abbeygate Accountancy Ltd, its directors and staff against any claim, loss, cost or expense (including reasonable legal fees) arising from your use of Forecourt, including from material you upload, from personal data you process through it, from photographs taken by your people, and from any breach of these terms by you or anyone using your account.
10. Ending the agreement
You can stop using Forecourt at any time by asking us to close the account. We can close an account for breach of these terms. On closure we delete your data within 90 days, except where the law requires us to keep audit records for longer.
11. General
These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction. If any part is found unenforceable the rest still applies. We may update these terms; the version you accepted is recorded against your account and we will tell you if a material change is made. Questions to hello@abbeygateaccountancy.co.uk.
